DA makes plea offer to anesthesiologist Aspen Daily News

Prosecutors have made a plea-agreement offer to a Glenwood Springs anesthesiologist charged with multiple felonies for his alleged sexual contact with some patients he treated.

Dr. Mark Rollin Young, 55, and his defense lawyer virtually appeared in Garfield County District Court on Thursday, the scheduled arraignment date for him to enter a plea to the offenses.

With the 9th Judicial District Attorney’s Office’s proposition pending before Young, however, Garfield County District Court Judge Denise Lynch postponed the plea date until Feb. 6. Details of the offer are confidential until and unless Young agrees to the deal.

“An offer has been extended in this and an expiration date is at the end of February, and I’ll leave it to defense counsel with how much time she would like to speak with her client,” said Deputy District Attorney Reede Neutze.

Young did not comment other than to say “I don’t have a preference” when the parties were scheduling his next court date. His defense lawyer in the case is Angela Campbell of Denver, who has declined to comment about this case.

Glenwood Springs Police arrested Young, who treated patients with ketamine-infusion sessions, in April. The 9th Judicial District Attorney’s Office charged him with one count of felony sexual contact with an at-risk person and four felony counts of sexual contact-fake medical exam, according to court records.

In a related development, Garfield County District Court Judge Elise Myer on Monday authorized a motion filed by lawyers who claimed Young has been dodging service of a civil lawsuit carried out by eight “Jane Does” claiming they were over-drugged and sexually molested while under his care.

Myer’s order allows the Jane Does’ representation to serve the lawsuit on Young via his attorney, Campbell.

The motion alleged Young evaded service at his Glenwood Springs home and where he is currently residing in Texas (Young received the court’s permission to leave the state to help an ailing family member).

Young is currently suspended from practicing medicine in Colorado for an undetermined amount of time.

Young agreed to the suspension with the Colorado Medical Board, which was investigating a patient's allegations that he was under the influence when she was under his care. Though Young denied the allegations, he agreed to not practice in Colorado for an indefinite period of time beginning in April 2023. The interim agreement, renewed April 16 of this year, does not constitute a disciplinary action or finding that Young engaged in unprofessional conduct.

The matter remains open with the board until a final disposition is made about his status. The board’s investigation into sexual-misconduct claims did not turn up conclusive evidence, according to medical board records.

Young received his license to practice medicine in Colorado in July 2006, according to public records. In Glenwood Springs, he owned and operated Apex Health Alliance, which did business under the names Apex Ketamine Therapy and Apex Mobile Anesthesia and Sedation Services.

Those businesses closed in December 2023. Before he opened his ketamine clinic, Young had privileges to work as an anesthesiologist at Valley View Hospital as well as Glenwood Oral Surgery.
